1. Acceptance of Terms
By accessing or using Kiwi Grow, you agree to be bound by these Terms & Conditions. If you do not agree to these terms, please do not use our Platform.
Kiwi Grow is currently in a pre-launch phase. Today the Platform consists of an informational website and a waitlist survey. The sections below that describe investment services, goal rewards, and withdrawals refer to planned functionality and will take effect only once those features are available.
2. Nature of Service
Kiwi Grow is a technology platform owned and operated by Havik Labs (Pvt) Ltd.
- Not a Financial Institution: Kiwi Grow is not a bank, licensed fund manager, stockbroker, or registered financial advisor.
- Intermediary Role: When Kiwi Grow launches, we will not hold, manage, or invest your money directly. Investment services, fund management, and asset custody will be provided exclusively through partnerships with third-party fund managers regulated by the Securities and Exchange Commission (SEC) of Sri Lanka.
3. Investment Risks & No Guarantees
The following applies to the investment features described on this website and will govern your use of those features once they become available:
- Market Risk: All investments in Unit Trust funds are subject to market risks. Net Asset Values (NAVs) fluctuate based on market conditions.
- No Guaranteed Returns: Any historical performance figures, graphs, calculator projections, or percentages displayed on our Platform (e.g., historical ~8.10%–8.83% returns) are for illustrative and educational purposes only. Past performance is not indicative of future results. Returns are not guaranteed.
- Limitation of Liability: Havik Labs (Pvt) Ltd is not liable for any financial losses, capital depreciation, or underperformance resulting from investments made through partner fund managers.
4. Goal Rewards Program
When launched, Kiwi Grow plans to offer brand discounts and lifestyle rewards (“Rewards”) to users who hit their designated savings goals. The terms below will apply to that program:
- Eligibility: Rewards will only be unlocked upon successful completion of the goal track. Early withdrawals or early redemption of funds prior to the set timeline will forfeit eligibility for the reward.
- Availability: Brand discounts and vendor partnerships are subject to change and vendor availability. Kiwi Grow reserves the right to modify, replace, or terminate specific rewards at any time without prior notice.
5. Withdrawals & Liquidity
Once investment features are available, open-ended unit trusts will generally allow you to withdraw your money at any time. Fund redemptions will be subject to the specific processing timelines (typically T+1 or T+2 business days) and banking regulations of the respective SEC-regulated fund manager. Kiwi Grow will not be responsible for external banking or fund processing delays.
6. Governing Law
These Terms & Conditions are governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka. Any disputes arising from these terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of Sri Lanka.
